Welcome to ATSOptimization. These Terms of Service ("Terms") govern your access to and use of the website at atsoptimization.com and the related software service (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. The service

ATSOptimization analyzes resumes against job descriptions and generates AI-assisted optimized versions to improve compatibility with Applicant Tracking Systems. The Service is provided as-is without warranty of employment outcomes. Optimization results are suggestions, not guarantees.

2. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your credentials and for all activity under your account. You must be at least 16 years old to use the Service.

3. Subscriptions and payment

Paid features are available via Monthly ($14.90/month) and Annual ($79/year) subscriptions, billed in advance through our payment processor LemonSqueezy. Subscriptions renew automatically until cancelled. You may cancel at any time from your account; cancellation takes effect at the end of the current billing period.

4. Refunds

Refunds are governed by our Refund Policy. In summary: full refunds within 7 days of purchase, provided you have not used any paid features (including the AI optimization tool). Once you generate an optimized CV using the paid Service, the purchase is non-refundable.

5. Acceptable use

You agree not to: misuse the Service to fabricate qualifications, submit content that infringes third-party rights, attempt to reverse-engineer or scrape the Service, or use the Service for any unlawful purpose. We may suspend accounts that violate these rules.

6. Your content

You retain ownership of resumes and job descriptions you submit. You grant us a limited license to process this content solely to provide the Service. We do not use your resume content to train AI models or share it with third parties beyond what is needed to deliver the Service.

7. Intellectual property

The Service, including its software, design, and branding, is owned by us and protected by copyright. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

8. Limitation of liability

To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind. We are not liable for indirect or consequential damages, lost employment opportunities, or the outcome of any job application. Our total liability is limited to the amount you paid us in the past twelve months.

9. Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these Terms. Sections that by their nature should survive termination will survive.

10. Changes

We may update these Terms. Material changes will be posted on this page with an updated date. Continued use after changes means you accept them.

11. Governing law

These Terms are governed by the laws of Bosnia and Herzegovina. Any disputes will be resolved in the competent courts of Bosnia and Herzegovina.
